These terms govern your use of the websites, digital products, and services operated by Entrepreneur.ing LLC, a South Dakota limited liability company. This includes entrepreneur.ing, johnmtorrens.com, podcast.johnmtorrens.com, adhdfoundr.com, vetfoundr.com, and futurefoundr.com. By using these sites or purchasing from us, you agree to these terms.

Who may use our services

You must be at least 18 years old and able to enter into a binding contract. Our services are intended for business owners, founders, and professionals acting in a business capacity.

Digital products

Digital products, including ebooks, guides, and downloadable resources, are licensed to you for your personal and internal business use. You may not resell, redistribute, publish, or share them, and you may not reproduce their contents for commercial purposes without written permission.

Access is typically delivered by email shortly after purchase. If you do not receive a product you purchased, contact john@entrepreneur.ing and we will deliver it.

Refunds on digital products

The ADHD Founder Playbook carries a 30-day money-back guarantee. If you are not satisfied, email john@entrepreneur.ing within 30 days of purchase and we will refund the purchase price. We may ask what did not work for you, but a refund is not conditional on your answer.

Other digital products are refundable at our discretion unless a specific guarantee is stated on the product page at the time of purchase.

Coaching and consulting services

Coaching engagements, consulting, and program enrollments are governed by the separate written agreement signed by you and Entrepreneur.ing LLC for that engagement. That agreement controls the scope of services, fees, payment schedule, cancellation, and refund terms for the engagement, and it prevails over these terms where the two conflict.

Absent a written agreement stating otherwise, fees for coaching and consulting services are non-refundable once the engagement has begun. We may, at our sole discretion, issue a partial or full refund or credit in individual circumstances. Doing so in one case does not obligate us to do so in another.

Strategy calls and discovery calls offered at no charge carry no obligation on either side.

Results and expectations

We do not guarantee specific business, financial, health, or personal outcomes. Our content and services provide frameworks, information, and guidance. Your results depend on factors outside our control, including your market, your execution, your circumstances, and your effort. Examples, case studies, and testimonials describe individual experiences and are not promises of what you will achieve.

Payments

Payments are processed by third-party payment processors, currently Stripe. By purchasing, you agree to the applicable processor terms. Prices are in United States dollars unless stated otherwise. We may change prices at any time, though a change will not affect a purchase already completed.

Intellectual property

All content on our sites, including written material, podcast episodes, frameworks, assessments, graphics, and design, is owned by Entrepreneur.ing LLC or used with permission, and is protected by copyright and other laws. You may share links to our public content freely. You may not republish substantial portions of it, present it as your own, or use it to build a competing product or program.

The book Lightning in a Bottle is subject to its own publishing terms.

Podcast guests and submitted content

If you appear as a guest on our podcast or submit material for publication, you grant Entrepreneur.ing LLC a non-exclusive, perpetual, worldwide license to record, edit, publish, distribute, and promote that appearance and material across any medium, including audio, video, written show notes, and social media. You confirm you have the right to grant that license and that your submitted material does not infringe anyone else's rights.

Acceptable use

• Do not attempt to gain unauthorized access to our sites, systems, or member areas
• Do not scrape, copy, or harvest content or contact information at scale
• Do not submit false information or impersonate another person
• Do not use our services for any unlawful purpose

We may suspend or terminate access for conduct that violates these terms.

Third-party links and services

Our sites link to third-party websites, platforms, and services we do not control. We are not responsible for their content, practices, or terms.

Disclaimer of warranties

Our sites, content, and services are provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our sites will be uninterrupted or error free.

Limitation of liability

To the fullest extent permitted by law, Entrepreneur.ing LLC and its members, officers, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business, arising from your use of our sites, content, or services. Our total liability for any claim relating to our sites, content, or services will not exceed the amount you paid us in the twelve months preceding the claim, or one hundred United States dollars if you paid us nothing.

Some jurisdictions do not allow certain limitations, in which case the limitations above apply to the fullest extent permitted.

Indemnification

You agree to indemnify and hold harmless Entrepreneur.ing LLC from claims, losses, and expenses, including reasonable legal fees, arising from your breach of these terms or your misuse of our sites, content, or services.

Governing law and disputes

These terms are governed by the laws of the State of South Dakota, without regard to its conflict of laws rules. Any dispute arising from these terms or our services will be brought exclusively in the state or federal courts located in South Dakota, and you consent to their jurisdiction.

Before filing any claim, you agree to contact us at john@entrepreneur.ing and attempt in good faith to resolve the matter directly for at least thirty days.

Changes to these terms

We may revise these terms. The date at the top reflects the most recent version. Continued use of our sites after a revision means you accept the revised terms.
